1. Acceptance of Terms

By accessing or using SafeKey Lab's privacy protection platform ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Services Description

SafeKey Lab provides enterprise-grade privacy infrastructure for data protection and compliance. Our Services include:

• PII Shield: Real-time detection and redaction of personally identifiable information
• AI Guard: Protection for LLM prompts and responses
• Compliance Suite: Automated GDPR, HIPAA, PCI DSS, and SOC2 compliance
• Multi-modal Protection: Text, image, audio, and document privacy processing
• API Access: RESTful APIs and SDKs for seamless integration

All Services support our unique Bring Your Own Cloud (BYOC) deployment model, ensuring your data never leaves your infrastructure.

3. Account Registration

To use our Services, you must:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the confidentiality of your account credentials
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to refuse registration or cancel accounts at our discretion, particularly if we suspect fraudulent or abusive activity.

4. BYOC Deployment Model

4.1 Your Infrastructure, Your Control

SafeKey Lab operates on a Bring Your Own Cloud model, meaning:

• All Services deploy directly within your AWS, Google Cloud, or Azure account
• Your data never leaves your infrastructure
• You maintain complete control over data residency and sovereignty
• We have no access to your data unless explicitly granted for support purposes

4.2 Your Responsibilities

When using our BYOC deployment, you are responsible for:

• Maintaining your cloud infrastructure and credentials
• Ensuring adequate compute resources for Service operation
• Managing cloud provider costs associated with running our Services
• Configuring network and security settings as recommended

5. Data Privacy & Security

5.1 Data Processing

We process data solely for the purpose of providing privacy protection services. Our data handling practices include:

• Processing data in memory without persistent storage unless explicitly configured
• End-to-end encryption for all data in transit
• Zero-knowledge architecture where technically feasible
• Compliance with GDPR, CCPA, and other applicable privacy regulations

5.2 Security Certifications

SafeKey Lab maintains:

• SOC 2 Type II certification
• ISO 27001 compliance
• Regular third-party security audits
• Continuous security monitoring and threat detection

6. Payment Terms

6.1 Subscription Plans

• Free Trial: 14-day trial with full features (no credit card required)
• Startup: $299/month for up to 100,000 API calls
• Business: $999/month for up to 1,000,000 API calls
• Enterprise: Custom pricing based on volume and requirements

6.2 Billing

• Subscriptions auto-renew unless cancelled before the renewal date
• Annual plans receive a 20% discount
• 30-day money-back guarantee for new customers
• Usage beyond plan limits incurs overage charges at published rates

7. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws, regulations, or third-party rights
• Process illegal, harmful, or malicious content
• Attempt to circumvent security measures or access restrictions
• Interfere with or disrupt Service operations
• Reverse engineer, decompile, or disassemble our software
• Resell or redistribute Services without written authorization
• Use Services for competitive analysis or benchmarking

8. Service Level Agreement

8.1 Availability

• Business & Enterprise: 99.9% uptime SLA
• Startup: 99.5% uptime target (no SLA)
• Scheduled maintenance excluded from uptime calculations
• Service credits available for SLA breaches (Enterprise only)

8.2 Support

• Startup: Email support, 48-hour response
• Business: Priority email support, 24-hour response
• Enterprise: 24/7 dedicated support with 1-hour response for critical issues

9. Intellectual Property

All intellectual property rights in the Services, including software, documentation, and trademarks, remain with SafeKey Lab. You retain all rights to your data and content processed through our Services.

You grant us a limited license to use your company name and logo for marketing purposes, which you may revoke at any time with written notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEKEY LAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount paid by you for the Services in the twelve months preceding the event giving rise to liability.

11. Termination

11.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support.

11.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• Your account has been inactive for more than 12 months
• We discontinue the Services (with 90 days notice)

11.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. We will delete your account data within 30 days unless legally required to retain it.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the modified Terms.

Entire Agreement

These Terms constitute the entire agreement between you and SafeKey Lab regarding the use of our Services.
